Request for Tenders: CONSULTANT for National Chemicals Management Policy and Costed Implementation Plan and Review and Update Legislative Framework for Chemicals and Waste Management as part of the “Strengthening the National Institutional Capacity for Chemicals and Waste Management in Vanuatu” project.
1. Background
The objective of the “Strengthening the National Institutional Capacity for Chemicals and Waste Management in Vanuatu” Project is to support country-driven institutional strengthening at the national level, in the context of an integrated approach to address the financing of the sound management of chemicals and wastes, taking into account the national development strategies, plans and priorities of each country, to increase sustainable public institutional capacity for the sound management of chemicals and wastes throughout their life cycle. Institutional strengthening under the Special Programme will facilitate and enable the implementation of the Basel, Rotterdam and Stockholm conventions, the Minamata Convention and the Strategic Approach to International Chemicals Management (SAICM).
The first session of the United Nations Environment Assembly (UNEA-1), in June 2014, in resolution 1/5 on Chemicals and Waste, further adopted the terms of reference for a Special Programme, to be funded by voluntary contributions, to support institutional strengthening at the national level to enhance the implementation of the Basel, Rotterdam and Stockholm conventions, the Minamata Convention on Mercury and the Strategic Approach to International Chemicals Management (SAICM). The Special Programme is one of two complementary elements of dedicated external financing under the integrated approach, with the GEF being the other element.
The Special Programme is part of the sub-programme 5 on chemicals and wastes in UNEP’s Programme of Work, in particular Project 515.2 Special Programme to support institutional strengthening at the national level to enhance the implementation of the Basel, Rotterdam and Stockholm conventions, the Minamata Convention and the Strategic Approach to International Chemicals Management (SAICM). It specifically addresses expected accomplishment (a) that countries increasingly have the necessary institutional capacity and policy instruments to manage chemicals and waste soundly including the implementation of related provisions in the multilateral environmental agreements (MEAs).
Following the third call for applications, the Government of Vanuatu submitted their application for funding from the Special Programme Trust Fund to strengthen their capacities for national implementation of chemicals and waste related international agreements. The Executive Board of the Special Programme, at its fourth meeting held from 29 to 31 January 2019 in Geneva, Switzerland, approved the application submitted by Vanuatu.
The following seven outputs are expected from the project:
1. Establish project implementation and governance arrangements
2. Develop a National Chemicals Profile for Vanuatu
3. Develop a National Chemicals Management Policy and costed implementation plan
4. Review and update the legislative framework for chemicals and waste management
5. Establish a centralised national database for chemicals and waste
6. Develop and deliver certified training programs in chemicals and waste management.
7. Provide implementation and enforcement training for the Conventions
2. Specifications: Statement of requirement
2.1 The Department of Environmental Protection and Conservation (DEPC) in Vanuatu is calling for Tenders from qualified and experienced persons who can offer their services to assist the DEPC in providing services for the “National Chemicals Management Policy and Costed Implementation Plan and Review and Update Legislative Framework for Chemicals and Waste Management” in Vanuatu.
2.2 The Terms of Reference and the scope of work of the consultant are set out in the Terms of Reference (Annex A).
2.3 The successful applicant will be working with the DEPC to develop the National Chemicals Policy and costed implementation plan and A draft legislation on chemical management prepared as a bill for parliament approval with its implementing materirials.
3. Conditions: information for applicants
3.1 To be considered for this tender, interested person must meet the following conditions:
- Must be residing in NSW or Queensland – Australia, North Island -New Zealand, Vanuatu and other countries in the South Pacific
- Submit details of previous relevant experience in similar consultancy work.
- Provide at least three referees as part of their tender application.
- There shall not be additional payments if the project is delayed and needs to be extended due to reasons that may be valid.
4. Submission guidelines
4.1 Tender documentation should demonstrate that the interested person satisfies the conditions stated above and is capable of meeting the specifications and timeframes.
Documentation must also include the supporting examples to address the evaluation criteria.
4.2 Tender documentation should outline the interested supplier’s complete proposal and include
(a) The CVs of proposed personnel highlighting related experience relevant to the tender;
(b) Complete the tender application form provided, Annex B. (please note you are required to complete in full areas requested in the Form, particularly the Statements to demonstrate you meet the selection criteria – Do not refer us to your CV or Technical Proposal. Failure to do this will mean your application will not be considered).
(c) A Technical Proposal, which contains the detailed methodology to achieve the tasks outlined in the Terms of Reference (Annex A); and
(d) A Financial Proposal, to reflect the scope of work in the technical proposal which is to be priced on a lump sum basis.
4.3 The financial proposal should only contain the personnel costs against the project activities. Project related activities will be paid for directly by the DEPC. Tender submission must be in USD. The consultancy has a maximum budget of USD35,000. Submitted proposals will be evaluated based on best value for money.
4.4 The Proposal must remain valid for 90 days from date of submission.
4.5 Tenderers/Bidders must insist on an acknowledgement of receipt of tenders/proposals/bids.
5. Tender Clarification
5.1. Any clarification questions from applicants must be submitted to [email protected] before 28th April 2021.
6. Evaluation criteria
6.1 DEPC will select a preferred supplier on the basis of the DEPC’s evaluation of the extent to which the documentation demonstrates that the tenderer offers the best value for money, and that the tenderer satisfies the following criteria:
(a) Previous experience in environment related works and understanding government capacities in Small Islands Developing States regions or equivalent developing country(ies) – (5)%;
(b) Demonstrated experience in writing policies and legislations and/or regulations related to chemical management and/or other relevant environmental issue – 20%;
(c) Technical Proposal clearly indicates/conveys a detailed methodology to achieve the tasks outlined in the Terms of Reference within the specified timeframes -25%
(d) Comprehensive knowledge in chemicals and hazardous waste and strategies necessary to their management – 20%;
(e) Minimum bachelor degree in Environmental Management, Chemical Management, other environmental related field and/or relevant working experience – 10%;
(f) Detailed Financial Proposal (20%)
6.2. Assessment of proposals will be based on the evaluation of the Technical Proposal (80%) and Financial proposal (20%).
6.3. The Financial Evaluation will award maximum points to the lowest priced bid (Based only on personnel costs on implementing the activities under the consultancy).
Subsequent bids will be awarded points calculated as a percentage of the lowest price.
